La Vie Wellness Terms of Service

Welcome to La Vie Wellness. These Terms of Service (“Terms”) govern your use of the La Vie Wellness website, including drinklavie.com, any purchases made from La Vie Wellness online, at a farmers market, or through any other La Vie Wellness sales channel, and your use of any products, services, subscriptions, content, and related offerings made available by La Vie Wellness (“La Vie,” “we,” “us,” or “our”).
By accessing our website, placing an order, purchasing a product, enrolling in a subscription, or otherwise using our services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our website or purchase our products or services.
1. Eligibility
By using our website or purchasing from La Vie Wellness, you represent that you are at least the age of majority in your state or jurisdiction of residence, or that you are using the website with the consent and supervision of a parent or legal guardian where permitted by law.
You may not use our website or services for any unlawful or unauthorized purpose.
2. Products and Services
La Vie Wellness offers beverages, ferments, cleanses, wellness products, food items, and related goods and services. All products are subject to availability. We reserve the right to modify, discontinue, limit, or refuse any product, service, order, or offering at any time, for any reason, without liability.
We make reasonable efforts to describe our products accurately. However, product descriptions, ingredient information, packaging, colors, images, and availability may vary and may not always appear exactly as shown online or in marketing materials.
3. Orders
When you place an order with La Vie Wellness, you agree that all information you provide is accurate, current, and complete.
We reserve the right to refuse, limit, cancel, or reject any order at our discretion, including where we suspect fraud, unauthorized activity, resale activity, pricing errors, inventory issues, or other misuse of our website or services.
An order confirmation does not guarantee acceptance of your order. We may cancel or modify an order before fulfillment if necessary.
4. Pricing and Payment
All prices are listed in U.S. dollars unless otherwise stated. Prices, fees, product availability, and specifications are subject to change at any time without notice.
By submitting payment information, you represent that you are authorized to use the payment method provided and authorize La Vie Wellness to charge the applicable amount, including any taxes, fees, recurring charges, or other amounts associated with your purchase.
If a payment cannot be processed, we may suspend, delay, or cancel your order or subscription.
5. Pickup Orders
Some La Vie Wellness orders are fulfilled through in-person pickup, including pickups at designated pickup locations, pickup windows, or farmers markets.
Customers are responsible for picking up their order on the scheduled date and within the designated pickup window communicated by La Vie Wellness.
Once an order has been prepared, packed, reserved, allocated, or made available for pickup, the customer is responsible for timely pickup. Orders not picked up on time may still be considered fulfilled.
La Vie Wellness is not responsible for deterioration, spoilage, damage, or quality changes that occur after the pickup window, after the order has been made available, or after the order has left our possession.
6. Farmers Market Purchases
Products purchased from La Vie Wellness at a farmers market are subject to these Terms, including all terms relating to refunds, product disclaimers, assumption of risk, and limitation of liability.
Because farmers market purchases are completed in person and products leave our control after purchase, all such sales are final unless La Vie Wellness chooses, in its sole discretion, to offer a replacement, store credit, or refund.
7. Subscription Orders
La Vie Wellness may offer recurring subscription products and services. By purchasing a subscription, you agree to the subscription terms below.
7.1 Subscription Renewal
Subscriptions renew automatically unless canceled, paused, skipped, or otherwise modified in accordance with these Terms and any available subscription management settings.
7.2 Payment Processing for Subscriptions
New subscription orders are charged at the time the order is placed.
Recurring subscription orders for weekend pickup are processed and charged every Wednesday.
Recurring subscription orders for Tuesday and Wednesday market pickup are processed and charged every Monday.
7.3 Subscription Cancellation and Change Deadlines
For weekend pickup subscription orders, changes or cancellations for the upcoming order must be made by Thursday at 11:59 PM.
For Tuesday and Wednesday market pickup subscription orders, changes or cancellations for the upcoming order must be made by Sunday at 11:59 PM.
After the applicable deadline, the order is considered final and may already be in production planning, inventory allocation, packing, or fulfillment preparation. La Vie Wellness is not required to honor requests submitted after the applicable cutoff.
7.4 Subscription Reminder Emails
Customers will receive a reminder email 4 days before their order is scheduled to go out.
Reminder emails are provided as a courtesy only. Failure to receive, open, read, or review a reminder email does not waive the customer’s responsibility to manage the subscription before the applicable deadline.
7.5 Missed Subscription Pickups
If a customer does not pick up a subscription order on the scheduled pickup date or within the designated pickup window, the order will still be considered fulfilled and the customer will remain charged in full.
La Vie Wellness may, at its sole discretion, offer a one-time courtesy exception for a first missed pickup. Any such exception is not guaranteed and does not create any ongoing right to reschedule, receive a remake, receive store credit, or receive a refund for future missed pickups.
7.6 Subscription Refunds
All subscription order sales are final.
Because subscription orders are prepared, packed, reserved, or allocated for a specific fulfillment cycle, La Vie Wellness does not offer refunds for missed pickups, late cancellations, change of mind, personal taste preferences, failure to manage the subscription before the applicable deadline, or products after pickup or after they have left our possession.
If a customer believes there was an issue with a subscription order, they must contact La Vie Wellness promptly. Any replacement, store credit, or refund is offered solely at the discretion of La Vie Wellness after review of the specific circumstances.
8. Refund Policy
Except as otherwise expressly stated by La Vie Wellness in writing, all sales are final.
Due to the nature of our products and the fact that many products are picked up in person, transported, stored, or handled outside of our control, we do not offer refunds for:
- change of mind
- personal taste preferences
- missed pickups
- late cancellations
- products after they leave our possession
- products not consumed within a customer’s preferred timeline
- dissatisfaction not based on a verified product or order issue
If you believe there was an issue with your order, you must contact La Vie Wellness promptly. Any replacement, store credit, or refund is offered solely at the discretion of La Vie Wellness after review of the circumstances. We reserve the right to determine the appropriate resolution, if any, on a case-by-case basis.
9. Product Storage and Handling
Customers are responsible for proper transport, storage, refrigeration, handling, and consumption of La Vie Wellness products after pickup or delivery, as applicable.
La Vie Wellness is not responsible for product deterioration, spoilage, contamination, or quality changes resulting from improper storage, delay in refrigeration, handling after pickup, or any condition outside our control.
10. Cleanse and Wellness Product Disclaimer
Certain La Vie Wellness products, including cleanse packages, probiotic beverages, raw beverages, and wellness products, may not be appropriate for all individuals.
Cleanses are not intended for use by minors, pregnant or nursing women, individuals with any type of health condition, or users of prescription drugs. Such individuals are specifically advised to seek professional medical advice before cleansing or consuming probiotic or raw beverages.
By purchasing or consuming La Vie Wellness products, you acknowledge that you are solely responsible for determining whether such products are appropriate for you.
11. No Medical Advice
La Vie Wellness is not a medical organization. Our owners, employees, contractors, staff, and representatives do not provide medical advice, diagnosis, treatment, or evaluation.
Any information provided by La Vie Wellness, whether on our website, in person, by email, by phone, through social media, through marketing materials, through customer service communications, or otherwise, is for general informational purposes only and should not be interpreted as a substitute for consultation with a licensed physician or other qualified healthcare provider.
You should consult your physician or qualified healthcare provider before beginning any cleanse, changing your diet, consuming probiotic or raw beverages, or using any product that may affect your health.
12. Assumption of Risk
By purchasing, consuming, or participating in any La Vie Wellness product, cleanse, program, or service, you acknowledge that participation is voluntary and undertaken at your own discretion and risk.
By purchasing a cleanse package or related products from La Vie Wellness, you accept full responsibility for your experience before, during, and after participation.
You understand and accept that food, beverages, probiotic products, raw products, and cleanses may affect individuals differently and may involve risks, including but not limited to digestive discomfort, allergic reactions, sensitivities, or other physical or mental reactions.
13. Allergies and Ingredient Awareness
La Vie Wellness makes reasonable efforts to communicate ingredients and product information, but we do not guarantee that any product is free from allergens, cross-contact, contamination, or trace ingredients unless expressly stated in writing.
Customers are solely responsible for reviewing ingredient information and determining whether a product is appropriate for their dietary needs, sensitivities, allergies, health conditions, or preferences.
If you have severe allergies, sensitivities, or medical concerns, do not rely solely on website descriptions or informal communications and consult us directly before purchasing. Even then, La Vie Wellness does not guarantee that products are free of all allergens or cross-contact.
14. Limitation of Liability
To the fullest extent permitted by law, La Vie Wellness and its owners, officers, employees, contractors, agents, affiliates, representatives, successors, and assigns shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or other intangible losses, arising out of or related to:

- participation in a cleanse or wellness program
- allergic reactions, sensitivities, digestive reactions, or other physical or mental reactions
- missed pickups
- order issues
- subscription billing or cancellation issues
- delays, interruptions, errors, or omissions
- third-party platforms, payment providers, or software providers
Without limiting the foregoing, La Vie Wellness accepts no liability or responsibility for any physical, mental, digestive, allergic, or other reaction experienced before, during, or after use of its products or participation in a cleanse, except where liability cannot be excluded under applicable law.
To the fullest extent permitted by law, if La Vie Wellness is found liable for any claim arising out of a product or order, our total liability shall not exceed the amount actually paid by the customer for the specific product or order giving rise to the claim.
15. Indemnification
You agree to defend, indemnify, and hold harmless La Vie Wellness and its owners, officers, employees, contractors, affiliates, representatives, and agents from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

- your negligence, storage, handling, transport, resale, or use of products after pickup or delivery
